If we reject your order after payment has been processed, we will issue a full refund to your original payment method.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final once an order has been confirmed and preparation has begun. Refunds or credits may be issued at our sole discretion in cases of:

- Items that are materially different from what was described;

- Orders that were not delivered due to our error.

However, our food is prepared in a kitchen that handles common allergens including but not limited to wheat, dairy, eggs, soy, tree nuts, peanuts, fish, and shellfish. We cannot guarantee that any menu item is completely free from cross-contamination with allergens.
If you have a food allergy, sensitivity, or dietary restriction, you acknowledge and agree that:
- You will review all available ingredient and allergen information before placing an order;
- You will contact us directly before ordering if you have specific allergen concerns;
- Pequod's Pizza is not liable for any allergic reactions, adverse health effects, or injuries arising from consumption of our products, except to the extent caused by our gross negligence or willful misconduct.
7. Disclaimer of Warranties

- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT OR INFORMATION ON THE SITE;
- WARRANTIES REGARDING THE QUALITY, SAFETY, OR SUITABILITY OF ANY FOOD PRODUCTS ORDERED THROUGH THE SITE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL PEQUOD'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- DAMAGES ARISING FROM YOUR INABILITY TO USE THE SITE OR SERVICES;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
- ANY OTHER MATTER RELATING TO THE SITE OR SERVICES;
EVEN IF PEQUOD'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PEQUOD'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
The limitations of liability in this section shall apply regardless of the theory of liability, whether based in contract, tort (including negligence), strict liability, warranty, or otherwise, and shall survive the termination of these Terms.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza, its affiliates, subsidiaries, officers, directors, employees, agents, contractors, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way connected with:
- Your access to or use of the Site or Services;
- Your violation of any provision of these Terms;
- Your violation of any applicable law, regulation, or third-party right, including any intellectual property, privacy, or consumer protection right;
- Any User Content you submit, post, or transmit through the Site;
- Any fraudulent, intentional, or negligent act or omission by you;
- Any dispute between you and a third party arising from your use of the Services.

- The Americans with Disabilities Act (ADA) regarding website accessibility;
- All applicable U.S. food safety regulations and guidelines issued by the Food and Drug Administration (FDA) and the U.S. Department of Agriculture (USDA).
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Pequod's Pizza at [email protected] and provide a written description of the dispute, including your name, contact information, a description of the claim, and the resolution you are seeking. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to binding arbitration as described below.
13.2 Binding Arbitration
EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT. Arbitration shall be conducted by a recognized arbitration organization under its then-current rules. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Pequod's Pizza agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
13.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
13.5 Time Limitation on Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
14. Term and Termination

A waiver of any breach or default of these Terms shall not be deemed a waiver of any subsequent breach or default.
19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by Pequod's Pizza on the Site, constitute the entire agreement between you and Pequod's Pizza with respect to your use of the Site and Services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the subject matter hereof.
